Learned counsel for the applicant filed photocopy of the order of this Court dated 23.9.2008 of co-accused Sonu Dixit in same case crime no. 73 of 2008 as well as order dated 26.11.2009 of this Court in case crime no. 191 of 2008 of present applicant Dinesh @ Lola. Both these orders be taken on record and be made part of the record.
Heard learned counsel for the accused applicant and the learned AGA.
It is contended on behalf of accused applicant that co-accused Sonu Dixit has already been enlarged on bail in the same crime number vide order of this Court dated 23.9.2008 and the case of the present accused too is at par with the co-accused Sonu. No conviction agaisnt the present accused applicant has been pointed out by the learned AGA and no other criminal history too has been shown.
Without going into merit of the case at this stage and considering the fact that co-accused has already been enlarged on bail, the present accused too be released on bail on the ground of parity.
Let accused applicant Dinesh @ Lola involved in Case Crime No. 73 of 2008 under Sections 395,397,412 IPC, police station Etmaddaula, District Agra be enlarged on bail on his furnishing a personal Bond and two sureties each in the like amount to the satisfaction of CJM concerned plus following undertaking that :-
1. The applicant will not tamper with the evidence during the trial.
2. The applicant shall report to the police station concerned in the first week of each month to show his good conduct and behaviour.
In default, the bail granted to the applicant shall be deemed cancelled and he shall be taken into custody forthwith.
