Rejoinder affidavit filed today is taken on record.
Learned counsel for the petitioner submitted that by the order dated 21.12.2001 the petitioner has already been absorbed as a third Assistant Teacher, therefore, the cause of the writ petition ceases. He further submitted that despite the aforesaid order, when the payment of salary has not been made, the petitioner filed Writ Petition No. 1659 of 2010 in which on 18.1.2010 the Court has directed the respondents to pay salary to the petitioner or to show cause but till date neither counter affidavit has been filed nor salary has been paid.
Learned Standing Counsel is directed to file counter affidavit within two weeks.
List on 16.10.2012. On that day, in case counter affidavit will not be filed, the District Samaj Kalyan Adhikari, Azamgarh shall appear in person.
