JUDGMENT / ORDER

Present application is filed by the convicts (two in number) through his mother seeking parole leave for both the convicts on the occasion of marriage of convict No.2.
2. Rule.
Learned Additional Public Prosecutor Mr.H.K.Patel waives service of process of Rule.
3. Learned Additional Public Prosecutor made available for perusal the Jail Remarks of both the convicts. The convicts are undergoing ten years imprisonment for the offences punishable under sections 395 and 397 of the IPC . The convict No.1 has undergone about 08 years and 09 months. Convict No.1 has enjoyed temporary bail and reported in time. He has enjoyed parole on three different occasions and except once, he reported in time. So far as convict No.2 is concerned, he has enjoyed temporary bail and reported in time. He has enjoyed parole on three different occasions and except once he reported in time.
4. Taking into consideration the contents of the application, the application is allowed. The convicts are ordered to be released on parole for a period of 20 days from the date of their release, on their executing a personal bond of Rs.5,000/-
(Rupees Five Thousand only) each to the satisfaction of the jail authorities.
5. Taking into consideration the absconding period of the convicts, convict No.1 is directed to mark his present to the nearest police station on alternate day. Whereas, convict No.2 shall mark his presence once in a week.
6. The convicts shall surrender to the jail authorities on expiry of the parole period.
7. Rule is made absolute to the aforesaid extent. Direct Service is permitted today.
