Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that the applicant has been challanned on the basis of four old cases shown in the gang chart but in those cases the applicant is on bail. However, the applicant is in jail since 22.7.2009 in the present case.
In view of the above, without expressing opinion on merit, it is a fit case for bail.l Let the applicant Dilshad Khalifa be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Case Crime No. 1729 /2009 under Section 3(1) U.P. Gangster and Anti Social Activities (Prevention) Act, PS. Kotwali, District Farrukhabad.
