Ref :- Criminal Misc. Correction Application No. 4 of 2019 Heard learned counsel for the appellants, learned counsel for the respondent as well as learned A.G.A. on the correction application.
This is an application for correction of the judgment dated 27.05.2019.
It is submitted by learned counsel for the appellant that vide judgment dated 27.05.2019 while allowing the aforesaid appeal in part, maintaining the conviction and sentence awarded to the accused for the period already undergone with the condition that the appellants have to pay compensation payable to the victim which is computed to the tune of Rs.2.5 lacs which would be distributed among the injured persons equally within a period of six months from the date of pronouncement of the judgment.
Learned counsel for the applicant submitted that in the compromise deed which is annexed as Annexure-4, it has been mentioned that amount of Rs.70,000/- has already been paid by them.
Be it so, this amount of Rs.70,000/- shall be taken into account and may be adjusted from the above-mentioned amount of Rs.2.50 lacs.
Secondly :
Learned counsel for the applicants further submitted that in paragraph 28 of the order dated 27.05.2019, the sentence ".....maximum period of three years, already undergone" may be deleted and in its place, "......the period already undergone" may be substituted.
The correction application is allowed. Let a fresh copy be applied and issued.
