The case of the applicant is based on applicability of The Juvenile Justice (Care and Protection of Children) Act, 2000 and amended in the year 2006. That on the date of offence namely 16.8.1999, the date of birth of the applicant-convict was 15.9.1981 and he was below 18 years and, therefore, entitled to the benefits contained in the Juvenile Justice Act defining juvenility and so interpreted by the Apex Court in the case of Hariram V/s State of Rajasthan and another, (2009)13 SCC 211, where it is held by their Lordships that the provisions so amended have retrospectivity. S.O. to 18.6.2012. Meanwhile, the Registry to place the record of Criminal Appeal No.543 of 2001 (disposed of) along with this case.
