JUDGMENT / ORDER

Shri Girish Das, learned Advocate for the Applicant appears and raises grievances about the manner and method in which the applicant was humiliated and nasty remarks were made by person opposing the case in the proceedings pending before the Charity Commissioner and complaint was filed before the learned Magistrate under Sections 499 and 500 of IPC, which came to be rejected without considering the relevant law on the subject. However, at the same time the revisional Court, while exercising power under Section 397 of the Code, found that the statements made by Shri Shailesh Ratibharti Goswami about the profession of lawyer and the applicant herein, was without any basis and is to be ignored and further the Charity Commissioner may consider such request if made by the applicant and advocate to delete the statement from the record of the proceedings in continuation of the order dated 18/02/2012 by the learned revisional Judge. The Charity Commissioner is to take decision of deleting such remarks made by the other side after following the procedure and as early as possible. Therefore, the petition is disposed of with no order as to costs.
