1. A grievance which is voiced in the present petition is that though order has been passed for higher pay scale, same has not be implemented and actual benefit of higher pay scale is not given to the petitioner.

In response to the notice issued by this Court, Mr.Pranav Dave, learned AGP has appeared on behalf of State Government and Mr.H.S.Munshaw, learned Advocate has appeared on behalf of respondent No.2 District Development Officer, Valsad. Mr.Dave, learned AGP has produced on record communication dated 20.08.2009 addressed by Under Secretary, Panchayat, Rural Housing and Rural Development Department, Government of Gujarat, Gandhinagar to the District Development Officer, Valsad granting sanction to grant benefit of second higher grade pay-scale to the petitioner in the pay scale of Rs.6500 10,500/- with effect from 01.06.2003 and same is produced along with affidavit affirmed by the Under Secretary. In view of above, no cause survives to continue with present proceedings.
3. Mr.Suthar, learned Advocate appearing on behalf of the petitioner has submitted that in view of subsequent communication dated 20.08.2009 no cause survives. However, it is requested to issue appropriate directions to the District Panchayat / District Development Officer, Valsad to make actual payment flowing from communication dated 20.08.2009.
4. In view of above, present petition is disposed of as no cause survives in view of subsequent communication dated 20.08.2009. Concerned respondents are directed to see that communication dated 20.08.2009 is implemented and actual payment is made to the petitioner at the earliest but not later than 12(twelve) weeks from today.
