JUDGMENT / ORDER

Mr.
Bhatt, learned advocate for the petitioner, has submitted that the proceedings have been terminated by the learned tribunal only on the ground of limitation. He also submitted that the delay caused in initiating the proceedings is not inordinate inasmuch as, the delay is of 276 days and appropriate order imposing costs to compensate the other side for delay caused in preferring proceedings could have been passed.
The learned advocate for the petitioner made request to withdraw present proceedings, at this stage, with a view to approaching learned tribunal with appropriate request to condone delay by appropriate order imposing costs or any other conditions, which the learned tribunal considers appropriate.
Request, as prayed for, is granted.
Petition stands disposed of as withdrawn.
If and when such application is preferred, the learned tribunal may consider the application on its own merits and pass appropriate orders in accordance with law.
With the aforesaid clarification, present petition stands disposed of accordingly.
