Heard learned counsel for the applicant/revisionist on recall application.
Criminal Revision No.4551 of 20110 was decided on 29.3.2012 by another Bench of this Court in absence of the revisionist.
Criminal Misc. Recall Application No.248563 of 2012 along with Delay Condonation application No.248560 of 2012, both supported by respective affidavits have been moved. The matter was released by the other Bench by its order dated 27.9.2012. It is contended on behalf of the revisionist that since the case was not marked by the counsel's clerk inadvertently therefore, none appeared on the date fixed. No objection against the recall application has been filed.
Grounds appear to be sufficient.
Delay in filing the recall application is condoned. The order dated 29.3.2012 is recalled. Revision is restored to its original number.
Criminal Misc. Recall Application No.248563 of 2012 stands allowed.
After restoration, the revision shall be listed on 13.12.2012 and the office shall also summon the records of the Courts below in the meantime.
