The petitioners, who are students of L.L.B. Five Year Course at S.G.M. Law College, Near Gowardhan Chauraha, Mathura, have filed the instant writ petition commanding the respondents not to interfere in the studies of the petitioners. The case of the petitioners is that they had passed re-examination of L.L.B. third year in the year 2017, after passing L.L.B. first year, L.L.B. second year and L.L.B. fourth year. However, the University is not permitting them to pursue their course any further and is compelling the petitioners to clear third year examination of L.L.B. course once again.
Sri Vivek Verma, learned counsel appearing on behalf of University, on instructions, states that the petitioners failed in certain papers in L.L.B. third year examination, therefore, in the next year they appeared in re-examination in the papers they had failed alongwith fourth year examination. They passed fourth year examination but failed in the re-examination of the third year papers. They passed the fourth year examination in the year 2016. They once again applied for appearing in re-examination of third year paper in the year 2017 which was not permissible. However, the University, by inadvertence issued admit cards and the petitioners were permitted to appear in the re-examination held in the year 2017, though it was impermissible.
Sri Vivek Verma does not dispute that in L.L.B. third year re-examination held in the year 2017, not only the petitioners were permitted to appear in the examination but they had also passed the same, therefore, he very fairly suggested that having regard to the peculiar facts of the instant case, the matter be sent to Examination Committee for according consideration to the grievance of the petitioners.
Accordingly, the instant petition is disposed of with direction to the second respondent to place the matter before the Examination Committee and whereafter the Examination Committee shall take decision in the matter within a period of six weeks. All consequential action shall be taken according to the decision of the Examination Committee.
