Heard learned counsel for the petitioner and learned Standing Counsel for the State- respondents.
The grievance of the petitioner in this writ petition is that the partition suit instituted in the year 2016 has not been decided till date.
Perusal of the order sheet of the proceedings which is being filed along with the supplementary affidavit today in Court reveals that no written statement has been filed by any of the parties. Therefore, the issues have not been framed, neither parties have led their evidence In view of the above, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no. 2, Sub Divisional Magistrate (in short 'SDM'), Padrauna, Kushinagar to consider and decide the case No. 05780 of 2016 ( T201605440105780) expeditiously, preferably within a period of 18 months from the date of production of a certified copy of this order before him.
