Court No. - 19
Case :- CONTEMPT APPLICATION (CIVIL) No. - 5104 of 2018 Applicant :- Dilip Kumar Opposite Party :- Praveen Kumar Bharti Counsel for Applicant :- Anil Kumar Pandey
Hon'ble Manoj Kumar Gupta,J.
Under order dated 8.12.2017, the claim of the applicant for regularisation was required to be considered and decided. However, no time frame was prescribed for deciding the claim.
According to learned counsel for the applicant, the applicant sent a certified copy of order of the Writ-Court to opposite party by registered post on 27.12.2017 followed by reminders, but no decision has been taken in the matter.
Since no time frame is prescribed in the order of the Writ-Court and therefore, this Court is not inclined to proceed in contempt against the opposite party. However, the contempt application is disposed of with the observation that in case consideration of claim is inordinately delayed, it shall be open to the applicant to approach this Court by way of a fresh petition.
The contempt application stands disposed of.
