JUDGMENT / ORDER

Hon'ble Shashi Kant,J.
Learned counsel for the appellant is permitted to correct the memo of the appeal, application for granting the leave to appeal and other documents by mentioning the correct S.T. Number.
Heard learned counsel for the appellant and learned A.G.A. for the State of U.P.
Learned counsel for the appellant files the supplementary affidavit with regard to the delay of seven days occurred in filing the appeal.
This application under section 5 of Indian Limitation Act has been filed with a prayer to condone the delay in filing the appeal against the judgment and order dated 28.3.2011 passed by learned Additional Sessions Judge, Ballia in S.T. No. 84/2010 connected with S.T. No. 295/2010 and S.T. No. 85/2010.
This appeal has been filed beyond the period of Limitation by 630 days.
Issue notice to the accused respondents through C.J.M., Ballia returnable within a period of six weeks from today to explain as to why the delay in filing the appeal may not be condoned.
