This public interest litigation raises the issue with regard to illegal continuance of a Headmaster in Junior High School.
The Supreme Court in the case of Dr. Duryodhan Sahu and others v. Jitendra Kumar Mishra and others, (1998) 7 SCC 273, has held that public interest litigation is not maintainable in service matters.
In view of the above, the public interest litigation is dismissed. We make it clear that since we have not considered the issue raised by the petitioner on merits, it is open for the petitioner to take recourse to such remedy which is available to him under law.
No order as to costs.
