Heard learned counsel for the parties and perused the record.
Learned Additional Chief Standing Counsel has submitted that in compliance affidavit an order has been annexed of the competent authority wherein it is provided that Governor has cancelled the order dated 2nd February, 2018 and direction has been issued to reinstate the petitioner on promotional post giving the grade pay of Rs.7600 as was admissible as per the order dated 30th June, 2016.
Thus, the order of the Division Bench of this Court has stood complied with. I have perused the order of the Division and find that there was a direction issued to the authority to open up sealed cover of promotion and benefits that were accrued to him dated 30th June, 2016 should be accorded. The order of compliance fully states that the petitioner has been given reinstatement on the promotional post w.e.f. 30th June, 2016 itself Thus, in the considered opinion of the Court, the order of Special Appeal Court has stood complied with.
In view of the above, no cause of action survives to maintain the contempt application and thus the notices are discharged.
Accordingly, the contempt application is consigned to records.
