Heard Shri Rajan Tripathi, learned counsel for the applicant.
The grievance of the applicant is that the order of the writ Court dated 28.11.2018 passed in Writ C No.29439 of 2018 as well as the order dated 9.5.2019 passed in Contempt Application (Civil) No.2837 of 2019 filed by the applicant have not been complied with.
In response of the order of this Court dated 25.7.2019, Shri Pradeep Kumar Tripathi, Advocate, appearing on behalf of the opposite party, on the basis of instructions, apprises to the Court that in response of the writ court order, the claim set up by the applicant has been decided by the Competent Authority vide order dated 14.8.2019 and alternative plot has been given to the applicant. After factual verification the applicant found that the said plot is also disputed and with detailed objections, he has apprised to the authority for allotment of another plot so that the writ court order may be complied with.
Learned counsel for the opposite party very fairly states that the process is on to provide the alternative plot to the applicant free from all encumbrances and for the said purpose, some reasonable time may be accorded.
It is admitted situation that so far as the grievance of the applicant is concerned, the same has not been redressed till now and, as such the matter cannot be adjourned any further.
Considering the facts and circumstances of the case, one more opportunity is afforded to the opposite party to comply with the aforesaid order of the Court and take a final call in the matter expeditiously and preferably within four weeks from the date of production of a certified copy of this order.
The applicant shall supply a duly stamped registered envelope addressed to the opposite party and another self-
addressed stamped envelope to the office within one week from today. The office shall send a copy of this order along with the self-addressed envelope of the applicant with a copy of contempt application to the opposite party within one week thereafter and keep a recorded thereof.
The opposite party shall comply with the directions of the writ court and intimate him of the order through the self- addressed envelop within a week thereafter.
With the aforesaid observations, this application is disposed of at this stage with liberty to the applicant to move a fresh application, if the order is not complied with by the opposite party within the stipulated time as aforementioned.
