HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.12053 & 12077 of 2008 COMMON ORDER:
Heard the learned counsel for the petitioners and the learned standing counsel for the respondents. The cause in both the writ petitions is one and the same and hence, they are being disposed of by way of this common order.
2. The petitioners filed the writ petitions challenging the inaction of the respondents in not paying the bills for the contract work entered by the petitioners for supplying and fixing of distribution boxes, pursuant to the Tender Notice/K2 Agreements for fixing in Balanagar Sub-Division, even in spite of submitting the bills. It is the case of the petitioners that though the same were check measured and entered in M-Book after due verification of the concerned authorities/Assistant Engineer and Assistant Divisional Engineer, the amounts due to the petitioners were not paid.
3. This Court by interim order dated 16.12.2010 in both the writ petitions, directed the respondents to release an amount of Rs.2,31,722/- (Rs.1,52,363/- + Rs.79,360/-) within a period of four weeks from today. Now the learned counsel for the petitioners states that his clients are not in touch with him and is not able to contact his clients due to change in the phone numbers and in spite of his best efforts he could not contact his clients.
4. In view of the interim order passed on 16.12.2010 in both the writ petitions and in the absence of any contempt case for non- implementation of the said order, it is assumed that the grievance in the writ petitions was settled.
5. Accordingly, both the writ petitions are closed. However, it is open to the petitioners to approach this Court, if the amounts were not paid under the above two writ petitions. Pending miscellaneous petitions in these writ petitions, if any, shall stand closed in consequence. No order as to costs.
