JUDGMENT / ORDER

The petitioners are the accused in Crime No.1188/12 of Hosdurg Police Station registered under sections 143, 147, 148, 341, 323, 324, 326 and 308 r/w 149 IPC, which is pending in committal proceedings as C.P.No.105/2013 on the file of court of Judicial First class Magistrate-I, Hosdurg. Annexure A1 FIR shows that the petitioners, on 14.11.2012 at 23.30 hrs., formed themselves into an unlawful assembly and attacked the de facto complainant by using knife, sticks etc. The de facto complainant entered appearance in this Court and submitted that he has no grievance against the petitioners and he has no objection in allowing this petition.
2. Heard the learned counsel for the petitioners, the learned counsel appearing for CW3, the learned counsel Crl.M.C.No.2481 of 2014 2 appearing for the de facto complainant and the learned Public Prosecutor.
3. Annexures A3 and A4 are the affidavits filed by the de facto complainant and the other injured. Considering the averments in the affidavits and also the fact that the matter has been settled between the parties, I find no meaning in continuing the prosecution against the accused. Therefore, this M.C. is allowed. Annexure A2 final report pending in C.P.No.105/2013 on the file of court of Judicial First class Magistrate-I, Hosdurg, is hereby quashed.
