Heard learned counsel for the petitioner as well as learned Standing Counsel Sri Alok Sharma and Sri Diwakar Singh, learned counsel appearing for the Gaon Sabha.
Present writ petition has been filed seeking a direction to the respondent no. 3 to cancel the illegal lease dated 15.8.2015 which was allotted by the respondent no. 5 in favour of the respondents no. 6 to 25 and to conduct an enquiry against the respondent no. 5 regarding allotment of illegal lease dated 15.8.2015 in favour of respondents no. 6 to 25 and also direct the respondent no. 2 to decide the representation dated 21.12.2018 moved by the petitioner, in accordance with law.
Admittedly the grievance is against grant of lease deed. The petitioner has statutory remedy against the order granting lease.
In such view of the matter, present writ petition is not maintainable as public interest litigation.
This writ petition is, accordingly, dismissed. No costs.
