Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and Sri Amit Kumar Pandey, learned counsel holding brief of Sri K.P. Singh, learned counsel for the respondent no. 2 and perused the record.
Present petition has been filed quashing the winner list 2021 issued by the respondents authority of Gram Panchayat Baliyapur, Block Sandalpur District Kanpur Dehat.
Having heard learned counsel for the petitioner and upon perusal of the record, this Court is of the opinion that the petitioner has a remedy by way of filing an election petition under Section 12-C of U.P. Panchayat Raj Act, 1947. As such I am not inclined to entertain the present petition. Accordingly, the petition is dismissed. Petitioner is at liberty to avail his remedy, if he is so advised.
