Heard Sri Siddharth Saran, learned counsel for the petitioners and Sri Pawan Shukla, learned AGA for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for quashing of the F.I.R. dated 9.9.2016, registered as case crime no.939 of 2016, u/s 419, 420, 467, 468, 447, 409, 504, 506 IPC, P.S. Munderwa, district Basti.
Learned counsel for the petitioners submits that petitioner is named in the FIR. As per allegation, main allegation has been levelled against co-accused Mohd. Mustafa Siddiqui. So far as petitioner is concerned, it is stated that the crime in question has been committed by the co-accused at the behest of the petitioner.
Learned AGA opposed the prayer for quashing of the FIR and submitted that the informant is a patient of Cancer and has been deceived by the petitioner along with co-accused persons.
After having examined the submissions advanced by learned counsel for the parties and perused the impugned FIR, we are of the opinion that the impugned FIR discloses cognizable offence against the petitioner, hence no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the FIR or for grant of any interim relief to the petitioner.
The petition lacks merit and is, accordingly, dismissed.
