(PER : HONOURABLE MR.JUSTICE JAYANT PATEL) It appears that pursuant to the order passed by the Apex Court in Civil Appeal No.3593-3594/12 dated 17.04.2012, the matter has been remanded to the Division Bench of this Court for consideration of the matter on the point as to whether possession was taken over by the appellant. It appears that in the meantime, Mr. J.R. Nanavati, who was representing respondent no.4 has expired and therefore, respondent no.4 will have to make alternative arrangement.
On behalf of Mr.Yogesh Lakhani, it has been stated by Mr. Bhargav Mehta that Mr.Lakhani has also no instructions in the matter and therefore, the respondent no.5 will have to be intimated about making appropriate arrangement if he is so desirous. The other respondents though were served, but have not appeared when the matter was heard and decided by the Division Bench. Hence, office to issue notice to respondents no.4 and 5 returnable on 20.12.2012. Additionally the process shall be served though Regd. Speed Post.
