Heard learned counsel for the parties.
The petitioner had taken a loan from Dewan Housing Finance Corporation Limited (DHFL), which is a private institution and does not come within the purview of Article 12 of the Constitution of India, therefore, it is not maintainable before this Court.
However, it is open to him to take recourse to the remedy of appeal under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 before the Debt Recovery Tribunal. We are not inclined to interfere in the matter at this stage.
The writ petition is accordingly, dismissed on the ground of statutory alternative remedy.
