Heard learned counsel for the applicant.
This petition alleges disobedience of an interim order dated 5 August 2016 in terms of which the learned Judge of the Court has directed the expeditious disposal of a suit pending in the court of the Additional Civil Judge (S.D.). The learned Judge had further observed that the concerned court would endeavour to conclude the suit preferably within a period of one year.
From a perusal of the order sheet, this Court finds that presently it cannot be said that the suit is being inordinately delayed by the concerned Presiding Officer. It is also evident that the applicant-plaintiff is enjoying a temporary injunction which had been passed in the suit.
Bearing in mind the principles enunciated by the Division Bench of the Court in Km. Shobha Bose Vs. Judge Small Causes And Others; 2010 (1) ADJ 531 (DB), the Court finds no ground to initiate proceedings in contempt.
The petition is dismissed.
