Heard Sri Vijay Tripathi, learned counsel for the applicants, Sri G.P. Singh, A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicants that the applicant no.1 was armed with country-made pistol and applicant no.2 and 3 were armed with lathi and danda. The victim alleged to have received injuries of fire-arm. Hence applicant nos.2 and 3 at least are entitled to be released on bail.
Learned A.G.A. have vehemently opposed the prayer for bail and submitted that the injuries sustained by the injured are of fire-arm but the other two accused have also participated in the crime in question.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicants Digambar Singh, Dharamvir Singh and Virendra Singh involved in Case Crime No. 373 of 2018, u/s 147, 148, 149, 307, 504 and 506 IPC, P.S. Kagaraul, districts Agra.
Accordingly, the anticipatory bail application is rejected.
However, the applicants are at liberty to move bail application u/s 439 Cr.P.C., if so advised.
