This revision has been against judgement and order dated 30.10.1991 passed by Sri Dileep Sahai, learned IInd Addl. Chief Judicial Magistrate, Jhansi in Case No. 64 of 1990 acquitting the accused opposite parties under sections 323, 325 IPC From a perusal of the impugned order passed by learned IInd Addl. Chief Judicial Magistrate, Jhansi it appears that the case has not been admitted and impugned order of acquittal has been passed in a just and legal manner, there is neither any perversity nor illegality. so as to warrant interference in exercise of revisional jurisdiction. Moreso, the revisionist is also not present to press this revision.
Accordingly, this revision is dismissed both on merit as well as for want of prosecution at this stage.
However, in case the cause of action still survives, the revisionist is at liberty to approach the Court by filing the recall application or any other remedy available under the law and procedure.
