1. Notice was issued to revisionist to engage another counsel on 15.12.2004. Office report dated 06.07.2006 shows that notice was received back unserved with the report that revisionist has left his village after selling his property. Vide order dated 18.12.2015, non-bailable warrant was issued to revisionist through Chief Judicial Magistrate, Budaun. Office Report dated 30.07.2019 shows that neither revisionist is residing in the village concerned nor there is any movable or immovable property of revisionist. In the circumstances, I myself have perused the record.
2. This criminal revision under Section 397/401 Cr.P.C., has been filed aggrieved by judgement and order dated 03.06.1988 passed by Sri Pooran Singh, IVth Additional Sessions Judge, Budaun dismissing Criminal Appeal No. 54 of 1987 filed against order dated 19.03.1987, passed by Sri Lakshmi Chand, Ist Additional Munsif Magistrate, Budaun in Criminal Case No. 276 of 1987 convicted applicant under Sections 325/323 IPC and sentenced him to undergo one year rigorous imprisonment with fine of Rs. 300/- and in case of default of payment of fine, he shall suffer further three months imprisonment.
3. Having gone through the record, I do not find any manifest error or otherwise illegality, procedural or otherwise, so as to justify interference in criminal revision.
4. Dismissed. Interim order, if any, stands vacated.
5. Certify this judgment to the lower Court immediately.
