Argument is that the case of the petitioner is similar to one Dr. Sneh Lata Pandey.
It is clearly mentioned in the impugned order itself that the qualification of Dr. Rajesh Kumar Pandey, who stood regularised, was the same.
Submission is that over all percentage of four subjects of CBSE examination is counted whereas in the examination of the U.P. Board it is on the basis of over all percentage of 5 subjects but that may not make any difference and only claim of the petitioner is that on the basis of passing out examination/certificate, the petitioner has been duly appointed.
The petitioner is permitted to file a supplementary affidavit annexing the qualification of Dr. Rajesh Kumar Pandey and the order of regularisation as noted in the impugned order at page 27.
