1. This Court by order dated 10.1.2012 passed in Special Civil Application No.175 of 2012 directed the applicant - original petitioner to file a representation. Para 6 of the said order dated 10.1.2012 reads as under:-
"6) In view of the above, if such a representation is filed by the petitioner to respondent no.1, the same shall be considered by the respondent no.1 as expeditiously as possible in accordance with law, after taking into consideration the contentions raised by the petitioner in the said representation. Considering the issue involved in the matter and more particularly considering the fact that the petitioner is working as daily wager Clerk since 1982 with respondent no,.1-Municipality, the above order is passed with a liberty to revive this petition in case, if any adverse order is passed."
2. It appears from the record of the application that thereafter, in compliance with the order dated 10.1.2012, the applicant filed representation dated 27.1.2012 and by order dated 1.3.2012, the said representation has been rejected by the Regional Director of Municipalities, Rajkot. Being aggrieved by the said rejection of representation, the present application is filed for revival of the main writ petition in Special Civil Application No.175 of 2012.
3. Mr.
M.T. Mishra, learned advocate for Mr. T.R. Mishra for the applicant seeks permission to withdraw this application with a liberty to file a substantive petition challenging the order dated 1.3.2012. It would be open for the applicant to file such a petition.
4. With the above liberty, the application is disposed of as withdrawn.
