Heard learned counsel for the applicant.
The present Transfer Application has been filed for transferring the proceedings of the Complaint case 5248 of 2007, under Sections 420, 465, 467, 468, 469, 471, 120B, 504 and 506 I.P.C. pending in the court of learned Metropolitan Magistrate Xth, District Kanpur Nagar to the Court having the same jurisdiction in the adjoining district. It is contended by learned counsel for the applicant whenever the applicant goes to District Kanpur Nagar to pursue the aforesaid case, he is being criminally assaulted by opposite parties no 2 and 3 and he apprehends danger to his life and person therefore, it is prayed, that the matter may be transferred to the adjoining district. The present transfer application is finally disposed of with the direction that, in case, the applicant apprehends danger to his life and person, he may move an appropriate application alongwith certified copy of this Court, before the Senior Superintendent of Police, District Kanpur Nagar with regard to his safety and security on the dates fixed in the aforesaid case, the same shall be considered and disposed off as expeditiously, as possible, in accordance with law, preferably within a period of 15 days from the date of filing of such application alongwith certified copy of this Court before him.
