Writ A No. 27373 of 2015 filed by the applicants was disposed of by judgment dated 27.3.2018, in terms of judgement in Writ A No. 44515 of 2016. The judgement dated 5.3.2018, in Writ A No. 44515 of 2016 required the respondents to consider the claim of applicants for appointment in case he is found suitable for the post in counselling held so far. The consideration was required to be made within a period of three months from the date of receipt of certified copy of the order.
Learned counsel for the applicant points out that a certified copy of the order of the Writ Court was sent to opposite parties on 4.4.2018 by registered post followed by reminders dated 4.5.2018 and 8.7.2018 also by registered post, but no decision has been taken in the matter so far.
This Court is of the opinion that before inaction on part of the opposite party in complying with the above direction is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to him to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order along with fresh representation before the opposite party and in which event, he shall ensure that compliance of the direction issued by the Writ Court is made within next eight weeks. In case the compliance is still not made, as directed herein, it shall be open to the applicant to initiate fresh contempt proceedings against the opposite party.
