Heard Sri Ashok Khare learned Senior Counsel in support of the petition and the learned Standing Counsel.
The principal prayer which is addressed on this petition reads thus:-
"Issue a writ order or direction in the nature of mandamus commanding the respondents to promote the petitioner on the post of Deputy Collector from 11.5.2016 on which date his juniors were given promotion on the post of Deputy Collector according to the promotion list dated 11.05.2016 issued by respondent No.2, within the short stipulated period as may be fixed by this Hon'ble Court."
The claim for promotion is itself raised in the backdrop of the provisions made in a Government Order of 28 May 1997 and more particularly to the provisions contained in Clause-10 thereof.
Learned Standing Counsel appearing for the first respondent states that subject to verification of all facts and contentions on merits being left open, the claim of the petitioner as raised shall be duly evaluated and a final decision communicated with expedition and preferably within a period of three months from the date of presentation of a certified copy of this order.
Accordingly and without going into the merits of the claim of the petitioner, this petition shall stand disposed of in light of the statement noted above.
