On the case being taken up today for hearing Sri Krishan Manohar Tiwari, holding brief of Sri Suresh C. Dwivedi, learned counsel for applicant and Sri Ram Tiwari, learned counsel for opposite party no.2 are present.
Learned counsel for parties submitted that parties have amicably settled their dispute by way of compromise. They have also filed a joint affidavit in this regard stating therein that parties have amicably settled their dispute out of Court by way of compromise and in pursuance thereof application for divorce with mutual consent has been allowed. They further submitted that opposite party no.2 now does not wish to continue proceedings of present criminal case any further, the same may be quashed.
Considering that parties have amicably settled their dispute out of Court by way of compromise and in pursuance thereof decree of divorce has also been passed and applicant and opposite party no.2 have been separated and opposite party no.2 now does not wish to continue proceedings of criminal case impugned in instant application any further. Keeping proceedings alive would be nothing but waste of time of Court.
In the result, application is allowed.
Proceedings of Complaint Case No. 5208 of 2016, under sections 498- A,323,504,506 IPC and 3/4 of D.P.Act, Police Station-Fazal Ganj, district Kanpur Nagar, pending in the court of Additional Chief Metropolitan Magistrate, court no.6, Kanpur Nagar are hereby quashed.
