1. By this application, the applicant seeks a direction to the respondents to grant Customs House Agent Licence to the petitioner without having to clear the examination in additional subjects and to dispose of the application/pending application of the petitioner for grant of licence treating the petitioner at par with applicants who had qualified under the Customs House Agent Licensing Regulations, 1984, subject to the petitioner fulfilling the other requirements under the Regulations.
2. Heard Mr. Nilay Anjaria, learned advocate for the applicant and Mr. P.S. Champaneri, learned Assistant Solicitor General appearing on behalf of the respondent no.1.
3. Rule returnable on 24th February, 2011. Mr. P.S. Champaneri, learned Assistant Solicitor General waives service of rule on behalf of respondent no.1.
4. Having regard to the submissions advanced by the learned advocates for the parties as well as in the light of the judgment and order dated 1st October, 2010 rendered by this Court in Special Civil Application No.6151 of 2010, by way of interim relief, the respondents are directed to consider the grant of Customs House Agent License to the applicant without having to clear the examination in additional subjects. The respondent no.3 is directed to dispose of the application/pending application of the applicant for grant of licences treating the applicant on a par with the applicants who had qualified under the Customs House Agents Licensing Regulations, 2004, subject to his fulfilling the other requirements under the Regulations.
