Heard Mr.Niral R. Mehta, learned advocate for the appellant and Mr.Kalpesh Nadia, learned advocate appearing for Mr.Y.N.Ravani, for the respondent No.1.
Mr.Mehta has submitted that at the time of filing of Appeal appellant was present and thereafter till date he has never remained present. He has further submitted that he has no instructions in the matter.
It is the duty of the appellant to appear before the Court through counsel or in person. When learned counsel is making statement that he has no instructions in the matter office is directed to issue non-bailable warrant in a sum of Rs.10,000/- (Rupees Ten Thousand Only) to the appellant. The non-bailable warrant is to be served through C.B.I. Gandhinagar.
Direct service is permitted.
