Heard learned counsel for the applicants and learned AGA for the State.
This application has been filed by the applicant with a prayer to quash the impugned order dated 7.3.2019 passed by Additional Chief Metropolitan Magistrate- I, Kanpur Nagar as well as non bailable warrant Dated 7.3.2019 in Criminal Complaint Case No.55 of 2015, under Sections 12 Domestic Violence Act, 2005, Police Station Kohana, District Kanpur Nagar, pending in the court of Additional Chief Metropolitan Magistrate- I, Kanpur Nagar.
Applicants claim that because of certain family problems, he could not appear before the court below. Now the applicants undertake that they will participate in the proceeding of the lower court.
Heard learned AGA for the State.
Since applicants have expressed their desire to participate in the proceeding, let a written undertaking be moved before the court below that applicants shall remain present and cooperate in the proceeding of the court below and they shall not occasion any delay in disposal of the trial, then case of the applicants shall be considered sympathetically and they shall be allowed to participate in the proceeding.
With the above direction, the instant application under Section 482 Cr.P.C. is finally disposed of.
