1. Challenge is made to the order of learned Principal Senior Civil Judge, Porbandar in Special Civil Suit No. 40 of 2003 whereby the Court rejected the request of present petitioner to add him as party defendant.
2. Learned advocate Mr. Shastri points out that application under Order 1 Rule 10 of Code of Civil Procedure preferred in the year 2004 came to be decided in March 2012. In the meantime Special Civil Suit No. 40 of 2003 is pending for setting aside the registered sale deed dated 11th October 2000 as also for declaration of the said sale deed as null and void other ancillary prayers. Petitioner apprehends collusion of the respondents herein to defeat his right and hence this petition.
