Petitioner has been placed under suspension vide order dated 25.1.2010. The aforesaid order was challenged by the petitioner by filing writ petition no. 8570 of 2010. The said writ petition was disposed of vide order dated 28.2.2010 with the direction that the enquiry in the matter shall be concluded within six weeks of the submission of the charge sheet which was directed to be given within 3 weeks.
The submission of the learned counsel for the petitioner is that till date neither any charge sheet has been given nor the enquiry has progressed. Thus, the order of suspension is liable to be quashed.
In view of the aforesaid facts and circumstances, the writ petition is disposed of with liberty to the petitioner to approach the authority concerned ie. District Development Officer, Aligarh for revocation of his suspension on the ground that the enquiry has not been completed within the stipulated period nor any charge sheet has been given. In case any such representation for revocation of suspension is filed within a period of two weeks from today, the authority concerned shall consider and pass a speaking order on the same within 3 months thereafter.
