Dheerendra Kumar Singh And ... vs M/S Asset Reconstruction Comp. ...

High Court Of Judicature at Allahabad|23 June, 2010

JUDGMENT / ORDER

Hon'ble Devendra Kumar Arora,J.
Through the instant writ petition the petitioner has challenged the action of the opposite parties 1 and 2 by impleading the District Magistrate, Lucknow as opposite party No.3, whereas the record does not reveal any role of the District Magistrate, Lucknow in the matter. Till date no action has been taken under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, therefore, we are of the view that the relief sought is absolutely aginist the private opposite parties, against whom the writ petition under Article 226 of the Constitution of India is not maintainable.
In view of above the writ petition is dismissed.
