The order impugned in this petition filed under Article 227 of the Constitution of India, is an order passed by the Principal Judge, Family Court, Azamgarh allowing an application for grant of interim maintenance under section 24 of the Hindu Marriage Act, 1955.
In view of the Full Bench decision of this Court in the case of Kiran Bala Srivastava Versus Jai Prakash Srivastava, 2006 All.C.J. 1936, an appeal lies against such order under section 19 of the Family Courts Act. In such view of the matter, this petition is dismissed with liberty to the petitioner to avail the alternative remedy as may be available under the Act.
In case, counsel for the petitioner files an application for return of the certified copy of the impugned order before the Registry, the same shall be returned after retaining a photocopy of the same on the record.
