Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the O.P. No.2, Sub-Divisional Magistrate, Shahganj, District Jaunpur for early decision of Case No. 90/T- 202114360103675 (Dheeraj Das vs. Indrasen Chaurasiya), u/s 133 Cr.P.C., P.S.- Shahganj, District Jaunpur, pending before him.
Learned counsel for the applicant has submitted that the O.P. No.2 has initiated proceeding in the aforesaid case and several dates have been fixed, in spite of that the O.P. No. 3 and 4 wilfully and knowingly enjoying the illegal encroachment over the public nuisance and till today no any needful action has been taken by the respondent No.2 against them. Further submission is that the pendency of the aforesaid case is nothing but purely harassment of the applicant with malice intention as such the case may be decided expeditiously.
In view of the aforesaid, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the Sub-Divisional Magistrate, Shahganj, District Jaunpur to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of three months from the date of production of a certified/computer generated copy of this order, if there is no other legal impediment.
