In pursuance of the order dated 14.12.2021 Sri Akash Tomar, presently posted as Senior Superintendent of Police Saharanpur and Sri Arvind Singh Pundir, Investigating Officer of this case are present before this Court. Sri Akash Tomar, Senior Superintendent of Police Saharanpur has filed a affidavit/progress of investigation. He seeks some time to trace out the victim and co-accused.
As prayed one month time is granted to police to trace out the victim and co- accused.
Put up on 25.1.2022 as fresh case.
Until further orders of this Court the personal appearance of Sri Akash Tomar and Sri Arvind Singh Pundir is exempted.
Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant seeking enlargement on bail in Case Crime No. 295 of 2020, under Sections 363, 368 IPC, at Police Station Rampur Maniharan, District Saharanpur.
Learned counsel for the applicant has submitted that the applicant is innocent and has been falsely implicated in the present case. The applicant is father of the co-accused Rohit @ Rocky. He has further submitted that in case the applicant is released on interim bail, he will not misuse the liberty of bail and would assist in the investigation. The applicant is in jail since 13.10.2020.
Let the applicant Dheer Singh, who is involved in aforementioned case crime be released on interim bail for a period of one month i. e. till 25.1.2022 on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned subject to condition that the applicant shall appear personally before the police station concerned on a weekly basis and/ or as and when called upon by the investigating officer to assist in the investigation. Further, before issuing the release order, the sureties be verified.
