Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari calling for all the records in relation to the sale and as stated in the letter Ref.No.TIIC/VLR/LAO-TK/2003-04, dated 17.03.2004 issued by the 2nd respondent and quash the same.
Prayer in W.P.No.8346 of 2004:
Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 2nd respondent to give the figures necessary for giving one time settlement to proceed with and also give reasonable time for payment of the 25% amount.
For Petitioner : Mr.G.Mahendran For Respondents : Mrs.Rita Chandrasekar for R2 M/s.Aiyar and Dolia C O M M O N O R D E R The petitioner has filed the writ petition in W.P.No.8345 of 2004 challenging the impugned auction notice and also filed W.P.No.8346 of 2004 seeking direction to the second respondent to give the figures for one time settlement and reasonable time for payment of 20% amount. While entertaining the writ petitions, this Court passed interim order on condition to deposit 50% of the auction amount and the petitioner also complied with the order. The learned counsel for the petitioner further submitted that subsequently, the petitioner paid the entire amount and auction was also cancelled. Hence, nothing survives in these writ petitions for adjudication and the same is accordingly, closed. No costs. Consequently, the connected miscellaneous petition is also closed.
