It is stated that petitioner has been working as Seasonal Collection Peon since 1993, but his claim for regularization has not been considered so far. Reliance is placed upon a notification dated 5.8.2016, whereby U.P. Seasonal Collection Peon Rules, 2004 was amended in order to contend that all existing vacancies were required to be filled through regularization, but in respect of District Basti, proceedings have not been undertaken so far.
Learned Standing Counsel, on the other hand, points out that petitioner has not worked for four fasli in 1993.
The objection is opposed by learned counsel for the petitioner contending that petitioner has continuously worked thereafter and his claim for regularization, in accordance with law, has not been considered so far.
In the facts and circumstances, noticed above, it is apparent that petitioner's claim for regularization has not been examined with reference to provision of the Rules, 2004 as amended on 5.8.2016.
Considering the above, this writ petition stands disposed of with a direction upon the respondent no.2 to accord consideration of petitioner's claim for regularization, strictly in accordance with law, within a period of four months from the date of presentation of certified copy of this order.
