Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Dharmveer Singh who is involved in Case Crime No. 272 of 2011 (Sessions Trial No. 343 of 2012), under Sections 307, 302, 504, 506 I.P.C., Police Station-Baldeo, District-Mathura.
As per prosecution version, on 4.10.2011 at about 5:30 AM on exhortation of applicant (Dharmveer Singh) other co-accused Nahar Singh, Amar Singh and Brajesh fired on Jaggo @ Jagdish.
Learned counsel for the applicant contends that the police has submitted final report in reference to applicant, however, he has been summoned on an application under 319 Cr.P.C. He further contends that role of the applicant is of exhortation and role of firing is assigned to other co-accused Nahar Singh, Amar Singh and Brajesh.
Learned A.G.A., has opposed the prayer for bail, however, admitted this fact that co-accused Nahar Singh and Brajesh have already been granted vide orders dated 22.7.2013 and 5.12.2011 passed by this Court in Criminal Misc. Bail Application Nos. 10773 of 2013 and 32828 of 2011 respectively.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant- Dharmveer Singh, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
