Heard learned counsel for the petitioner and learned Standing Counsel for the contesting respondents.
By means of present writ petition, petitioner has sought following relief(s):
"(i) issue a writ order or direction in the nature of mandamus commanding/directing the respondent Authority to promote the petitioner in 3rd Semester of two years serving (Deceased- Dependent) B.T.C. Training and also allowed to appear in 4th Semester examination schedule to Nov.2020, by mean of a policy decision taken by the Government order dated 16.9.2020.
(ii) issue any such other and further writ, order or direction which this Hon'ble Court may deem fit and proper into facts and circumstances of the case so that justice may be done.
(iii) award the cost of the writ petition to the petitioner through out."
Learned Standing Counsel claims that the prayer itself shows that the relief sought has become infructuous. However, the petitioner's counsel claim that in this regard a representation has already been moved before the respondent 5, which is Annexure No.6 to the writ petition.
It is directed that the petitioner may move fresh copy of representation before respondent no.5 within four weeks from today and in case any such representation is so made, the same shall be considered and disposed of by reasoned and speaking order within a period of six weeks next from the date of production of certified copy of this order before it.
With the aforesaid direction, the instant petition is disposed of.
