Heard Sri R.J. Singh, learned counsel for the petitioner, Sri G.P. Singh, learned A.G.A. and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer that suitable direction may be issued to the respondent nos. 2 and 3 to conduct fair and impartial investigation in relation to F.I.R. dated 10.8.2016 registered as case crime no. 491 of 2016 under section 302 I.P.C., police station Baksa, District Jaunpur and arrest the accused-respondent nos. 4 and 5 immediately.
Learned counsel for the petitioner submits that the petitioner is the informant of the case. He lodged the present F.I.R. on 10.8.2017 in which final report was submitted and on the protest petition filed by the petitioner, learned Magistrate has ordered for further investigation in the matter on 6th May, 2018 but till date the investigation has not been concluded, hence he has come up before this Court by filing the present petition.
Learned A.G.A. has pointed out that the learned Magistrate in his ordered dated 6th May, 2018 has already ordered for concluding the further investigation within a period of three months from the said date, hence no interference is called for by this Court.
Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the parties, we are not inclined to interfere in the matter.
The petition is, accordingly, dismissed.
