Heard learned Counsel for the petitioner and learned Standing Counsel.
The petitioner alleges that he has been granted fishing rights over a pond plot no.370 area 0.530 hectare situate in Village Sehra, Tehsil Madhiyau, District Jaunpur. The petitioner on the basis of the said lease deed-put seeds for pisciculture in the said pond but the private respondents 5 to 9 have taken away all the fishes, therefore, he wants that appropriate action be taken against the said private persons by the police authorities. If that be so, the petitioner may go and lodge a First Information Report or a complaint again the private respondents.
The writ petition for the above purpose is not the proper remedy. It is accordingly dismissed with liberty as aforesaid.
