Heard learned counsel for the petitioners and learned Standing Counsel.
This writ petition has been filed for quashing the order dated 19.07.2019, whereby the revision filed by the petitioners was admitted and the application for interim relief was rejected. Further prayer has been made for the issuance of mandamus commanding the respondent no.1-Additional Commissioner (Judicial) Second, Bareilly Mandal, Bareilly to decide the Revision No. 01641 of 2018, computer no. C201812000001641 filed under Section 210 of Land Revenue Code, 2006 within stipulated time.
The contention of learned counsel for the petitioners is that land in dispute was allotted to them on 2.9.2015 for agricultural purpose and their allotment was cancelled vide order dated 30.10.2017 passed by the Additional District Magistrate (Judicial), Shahjahanpur. Against that order, Revision No. 01641 of 2018 under Section 128 of U.P. Land Revenue Code, 2006 alongwith application for interim relief was filed. The revisional court vide order dated 11.7.2019 admitted the revision and issued notice to the other side but rejected the said application. It is further contended by learned counsel for the petitioners that petitioners are in possession from the date of allotment in their favour, an interim order is necessary considering the facts and circumstances of the case and in case, they are dispossessed irreparable loss will be caused to them and they will be deprived of only source of income.
I have considered the submissions so raised by learned counsel for the petitioners and perused the record.
Under these circumstances, since the revision is pending since 2018, respondent no.1-Additional Commissioner (Judicial) Second, Bareilly Mandal, Bareilly is directed to decide the Revision No. 01641 of 2018 under Section 128 of U.P. Land Revenue Code, 2006 as expeditiously as possible preferably within a period of six months from the date of production of certified copy of this order without any unnecessary adjournment to either of the parties.
Writ petition is, accordingly, disposed of.
For a period of six months, parties are directed to maintain status quo over the land in dispute.
